Brainarm website and music Terms and Conditions of Use
By accessing this Website, accessible from www.brainarm.com, you are agreeing to be bound by these Website Terms and Conditions of Use and agree that you are responsible for the agreement with any applicable local laws. If you disagree with any of these terms, you are prohibited from accessing this site. The materials contained in this Website are protected by copyright and intellectual property law and is property of the B-Team (represented by Guido Mallardi). Any music composed via the Brainarm Full Compositional Coaching method belongs to their respective composers (the “Brainarmers” or the “authors”).
- Use License
Permission is granted to the visitor to download the music scores that are available for free at http://www.Brainarm.com/music. Any other website you might be allowed to download such music from is illegal and is acting without the B-Team authorization, therefore the B-Team shall not be liable for such infringement/s.
This is the grant of a license, not a transfer of title, and under this license you are not allowed to:
- modify or copy the materials;
- use the materials for any public display or performance without obtaining previous consent and sub-licence from the B-Team (in order to get such consent, write an email to info [at] brainarm [dot] com);
- attempt to reverse engineer any software contained on this Website;
- remove any copyright or other proprietary notations from the materials;
- transferring the materials to another person or "mirror" the materials on any other server;
- alter the material;
- commercialize the material.
This will let The B-Team to terminate upon violations of any of these restrictions. Upon termination, your viewing right will also be terminated and you should destroy any downloaded materials in your possession whether it is printed or electronic format.
The above does not apply to you if you are the author of such music.
Upon agreement with each brainarmer (or parent/guardian, if the brainarmer is a minor) whose music has been published at Brainarm.com, the B-Team has been granted non-exclusive licence for full usage of such music, including the right to copy and issue copies in print or digital form, perform or communicate it to the public and sub-licence it for the full term of such rights, without any geographical limitations and without claiming any royalty for the recording, performance, and/or distribution of such music. All such applies also to any other professionals sub-licenced by the B-Team.
The right of commercialising this music will be granted only to the B-Team, in which case any royalties will be split (20% to the author and 80% to the B-Team). 100% of the royalties will be granted to the author only upon further specific agreement with the B-Team (see the “Premium service” at the home page www.brainarm.com).
All the materials on Brainarm.com are provided “as is”. The B-Team makes no warranties, may it be expressed or implied, therefore negates all other warranties. Furthermore, The B-Team does not make any representations concerning the accuracy or reliability of the use of the materials on its Website or otherwise relating to such materials or any sites linked to this Website.
The B-Team or its suppliers will not be hold accountable for any damages that will arise with the use or inability to use the materials on Brainarm.com, even if The B-Team or an authorize representative of this Website has been notified, orally or written, of the possibility of such damage. Some jurisdiction does not allow limitations on implied warranties or limitations of liability for incidental damages, these limitations may not apply to you.
- Revisions and Errata
The materials appearing on Brainarm.com may include technical, typographical, or photographic errors. The B-Team will not promise that any of the materials in this Website are accurate, complete, or current. The B-Team may change the materials contained on its Website at any time without notice. The B-Team does not make any commitment to update the materials.
The B-Team has not reviewed all of the sites linked to its Website and is not responsible for the contents of any such linked site. The presence of any link does not imply endorsement by The B-Team of the site. The use of any linked website is at the user's own risk.
- Buying from this Website and Return Policy
Please notice, if you live in the EU you must be 16 to make a transaction from Brainarm.com.
Any physical goods will be delivered by courier.
Any order of physical goods can be cancelled by contacting us via the contact form within 14 days of receiving physical goods. You have another 14 days to return the goods once you have told us you want to return it.
If the goods you have purchased are non-physical like Brainarm session packages and Webinar subscription tickets you have 14 days to ask for a refund. However, if you cancel later than 7 days from the event or first session, 20% of the entire price as booking fee will be kept.
In regard to Ebooks and Qualification bundles no refund at all will be possible. Ebooks are downloaded, which means they cannot be returned in any way. A qualification bundle is downloaded too, and allows you to get the know-how about Brainarm, which of course cannot be forgotten once it has been acquired.
- Governing Law
Any claim related to this Website shall be governed by the laws of United Kingdom without regards to its conflict of law provisions.
